A petition by the Department of Energy (DoE) for a claim rehearing was refused by the US Court of Appeals for the Federal Circuit on 12 December. The move has cleared the way for Yankee Atomic, Maine Yankee and Connecticut Yankee to proceed with their damages claim against the DoE for contractually failing to take title to their spent fuel by 31 January 1998. The three utilities asked the US Court of Claims on 15 December to raise a stay imposed by the claims court in 1999. The companies filed for damages in 1998. Other utilities are now expected to file their own claims.
